INVESTIGAÇÃO CRIMINAL DEFENSIVA: LIMITES E POSSIBILIDADES DE EFETIVAÇÃO NO BRASIL À LUZ DA POLÍTICA CRIMINAL
Abstract
O presente artigo aborda o tema investigação criminal defensiva e a sua efetivação como política criminal limitadora da expansão do direito penal. A Teoria do Garantismo Penal possui dentre um dos seus axiomas o direito à prova. Por outro lado, a política criminal expansiva e punitivista do direito penal tem suprimido garantias constitucionais e processuais do imputado para dar a falsa impressão de celeridade e eficientismo na resposta penal, o que degenera os princípios basilares do direito penal moderno. A metodologia da pesquisa utilizada no estudo é a bibliográfica e a documental que se debruçam acerca do tema proposto. Nessa perspectiva, demonstra-se que é preciso alterações legislativas para a efetivação da investigação criminal defensiva, como uma medida de política criminal, com a finalidade de ser uma ferramenta essencial ao direito de defesa, o que vai garantir o direito fundamental à prova em contraditório para o justo processo.
