Right to personal identity: a user's manual
a user's manual
Abstract
The purpose of this paper is to investigate the usefulness of the right to personal identity as a tool for the plural realization of the principle of human dignity, particularly in light of its function of providing narrative coherence and functional nexus to all attributes of the individual, by linking them to a concrete, tangible life project worthy of protection. The pape is divided into three parts: the fist topic addresses the challenge faced by legal practitioners in deriving concrete solutions from the direct application of the general clause of human protection; the second topic examines the doctrinal framework that gave rise to the right to personal identity in Italy as one of the manifestations of human personality; the third and final topic explores the application of the right to personal identity in the Brazilian legal system with numerous examples illustrating its practical use.
