A THE LEGAL CONDITION OF SINGLE WOMEN IN THE MEDIEVAL IBERIAN PENINSULA FROM THE FUERO REAL AND THE BOOK OF LAWS AND POSTURES
Abstract
The study of the legal status of women in the 21st century by both jurists and historians thanks to the demands of contemporary society. This raises two reflections: the fluidity inherent in the very notion of female legal identity and the influence that medieval culture exerts on the elaboration of the current female identity. It is to contribute to this debate that we will analyze some of the elements that influenced the elaboration of a legal conception about medieval women, based on the analysis of two of the legal codes that supported a large part of the Latin American legal tradition: the Fuero Real and the Book of laws and postures.
The objective of this article is, therefore, to identify and compare, in the two selected legal codes, some legal aspects involving the assignment of social roles to medieval single women in the kingdoms of Castile and Portugal, in the 13th century
