THE LEGAL DECISIONS OF CARL SCHMITT
Abstract
This study aims to discuss the jusphilosophical theory of Decisionism, which is based on the knowledge base of scholars in this strand of thought, such as Carl Shimitt. In Schmittian understanding, the sovereign decision is the absolute beginning, and the beginning is nothing more than a sovereign decision that takes exceptionality as a commandment. Since there is no rule to apply to chaos, order must be established by a decision. She, the decision, is what will make the order meaningful. In elaborating the premises of his theory, Schmitt considers that the sovereign will puts an end to disorder and ensures, through his commandments, law, security and peace. It is in this context that the idea of exception arises (from the Latin Excipere, that is, to take from or take from) and that the sovereign decision consists in abstracting itself from the disorder and subtracting itself from the normative nothingness to move to a rule of law.
