JUSTIÇA COMO EQUIDADE E DESENVOLVIMENTO DAS LIBERDADES NO DIREITO FUNDAMENTAL A RENDA BÁSICA FAMILIAR
Abstract
O presente artigo versa sobre definição de renda básica, introduzido no parágrafo único do artigo 6º da Constituição Federal, por meio da Emenda Constitucional 114/2021. Uma análise dos dispositivos que foram acrescidos com a emenda e a proteção social, a ordem social e econômica e os princípios assistenciais e as repercussões jurídica no âmbito do Supremo Tribunal Federal sobre renda básica e mínimo existencial. O artigo ainda versa sobre a renda básica e a justiça rawlsiana como equidade e cooperação social, além de beber na fonte da liberdade, bem-estar e privações de capacidades do indiano Amartya Sen, como forma de enfrentamento das desigualdades sociais persistentes no país.
