SOVEREIGNTY OF STATES AND AUTONOMY OF PEOPLE: QUIS CUSTODIET IPSOS CUSTODES? A BRIEF CRITICAL LOOK
Abstract
The protagonism of the will of the people above the sovereignty. This is one of the main pillars of the critical thinking of Luigi Ferrajoli. The present reflection seeks to align the contemporary junction of sovereignty of the States and the regulation of the Right, bringing, however, the subjects within the narrative, taking them from the place of liabilities that adhere to the imposed norm, to effective citizens responsible for the regulation of the Sovereign states, not the current reverse.
